Please read these Terms of Service carefully before using WattaWave. These Terms govern your access to and use of our platform and services. By using WattaWave, you agree to be legally bound by these Terms.
Acceptance of Terms
By accessing or using WattaWave (the “Platform”), including our website, mobile applications, and related services, you agree to be bound by these Terms of Service (“Terms”). These Terms form a legally binding agreement between you and WattaWave, Inc. If you do not agree with any part of these Terms, you must not use the Platform.
These Terms apply to all users of the Platform, including renters, boat owners, administrators, and visitors. We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or platform notification. Your continued use of WattaWave after changes become effective constitutes acceptance of the updated Terms.
Services
WattaWave is an online marketplace that connects individuals seeking boat rental experiences (“Renters”) with individuals or entities who list boats for rent (“Owners”). WattaWave facilitates the listing, discovery, booking, and payment process but does not own, operate, or manage any boat listed on the Platform.
WattaWave is not a party to any rental agreement between Renters and Owners. We do not control the conduct of Renters or Owners and disclaim all liability arising from such relationships to the maximum extent permitted by law. All representations and warranties regarding boats are made solely by Owners.
We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Platform without notice or liability.
User Accounts
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate, current, and complete. You must be at least 18 years of age to create an account and use WattaWave.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify WattaWave immediately at security@wattawave.com if you suspect any unauthorized access to your account. WattaWave is not liable for any losses resulting from unauthorized use of your account.
A single account may be used as both a Renter and an Owner. WattaWave reserves the right to suspend or terminate any account that violates these Terms, at our sole discretion, with or without notice.
Booking & Payment
All bookings are subject to Owner availability and approval. When a Renter submits a booking request, no contract is formed until the Owner confirms the booking. Upon booking confirmation, payment is collected from the Renter via Stripe and held in escrow on the WattaWave platform until trip completion is verified by both parties.
Renters are charged a 6% service fee on top of the Owner's listed daily rate. This fee covers payment processing, customer support, identity verification, and platform operations. Owners receive the base booking amount minus a 7% platform commission fee, which covers listing tools, payment infrastructure, and support services.
WattaWave uses Stripe, Inc. for all payment processing. By making or receiving payments through the Platform, you agree to Stripe's Terms of Service and Privacy Policy. WattaWave does not store credit card numbers or sensitive payment details on its servers.
Cancellation Policy
WattaWave applies a standard cancellation and refund policy to all bookings unless an Owner has specified and published a different policy on their listing. Cancellations made more than 48 hours before the trip start time will receive a full refund of the amounts paid. Cancellations made between 24 and 48 hours before the trip start time will receive a 50% refund. Cancellations made less than 24 hours before the trip start time are non-refundable.
If an Owner cancels a confirmed booking, the Renter will receive a full refund of all amounts paid, including the service fee. WattaWave reserves the right to issue additional refunds or credits at its discretion in cases involving safety concerns, platform policy violations, or extraordinary circumstances.
Refunds are processed via the original payment method and may take 5–10 business days to appear, depending on your bank or card issuer. WattaWave is not responsible for delays caused by financial institutions.
Owner Responsibilities
Owners are solely responsible for ensuring that their boat is safe, seaworthy, legally compliant, and accurately described in their listing. Owners must hold all licenses, permits, and insurance required by applicable law to operate their vessel and rent it to third parties. WattaWave strongly recommends that all Owners maintain comprehensive marine insurance coverage.
Owners must respond to booking inquiries and requests within 24 hours and must honor all confirmed bookings. Repeated cancellations, misrepresentation of listings, or failure to meet basic safety standards may result in account suspension or permanent removal from the Platform.
Owners are responsible for collecting and remitting any applicable taxes (including VAT, GST, or income tax) related to their rental income. WattaWave does not withhold, file, or pay taxes on behalf of Owners.
Renter Responsibilities
Renters agree to use any rented boat responsibly and in accordance with applicable laws and regulations, including any boating license requirements. Renters must treat rented boats with care and return them in the same condition as received, reasonable wear and tear excepted. Renters are liable for any damage caused by their negligence or misuse.
Renters must be truthful in their profiles, booking requests, and communications. Misrepresenting your identity, qualifications, or intended use of a boat may result in immediate account termination. Renters must be 18 years of age or older to make a booking.
If you are involved in an accident, incident, or damage event during a rental, you must notify the Owner and WattaWave immediately at support@wattawave.com. Failure to report incidents may affect your rights under any applicable insurance coverage.
Prohibited Conduct
You agree not to use WattaWave for any unlawful purpose or in violation of these Terms. Prohibited activities include: creating false listings or fake reviews; using the Platform to engage in fraudulent transactions; circumventing the Platform to conduct payments outside of WattaWave's systems; harassment, threats, or abusive behavior toward other users; and uploading or transmitting malicious code.
You also agree not to scrape, crawl, or otherwise extract data from the Platform in bulk; attempt to gain unauthorized access to any portion of WattaWave's systems; or interfere with or disrupt the integrity or performance of the Platform. Violation of these restrictions may result in immediate account termination and potential legal action.
Limitation of Liability
To the maximum extent permitted by applicable law, WattaWave and its officers, directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, personal injury, or property damage, arising out of or related to your use of the Platform, even if we have been advised of the possibility of such damages.
WattaWave's aggregate liability to you for any claims arising out of or related to these Terms or your use of the Platform shall not exceed the total amount of service fees paid by you to WattaWave in the 12 months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, WattaWave's liability will be limited to the greatest extent permitted by applicable law.
